Terms of Service - Commissions
Hereinafter: ‘Me, I, Artist’ refers to Dae, acting as the artist. ‘You, Client, Commissioner’ refers to the client, requesting a commission.
I. GENERAL INFORMATION
- It is prohibited to use commissioned artwork to train AI or use it for AI purposes of any kind. Uploading, posting, or editing any commissioned artwork or licensed piece into artificial intelligence programs by the Client is prohibited.
- The artist has the right to decline a client for any reason without needing to provide why they are declining.
- Harassing, threatening, or insulting the artist automatically cancels a commission with no refund.
- Any monetary compensation made without the written consent of the artist is treated as a donation.
- Visual reference is required, I typically do not work with description only. If the client provides no visual reference, the artist will charge more.
- The Client is responsible for obtaining licenses from any third-party copyright holder of character(s) depicted in the artwork.
- The Client is restricted from putting any commissioned artwork or licensed piece up for sale as NFT (non-fungible token).
- At no point will the artist accept inquiries for NFT's.
II. PAYMENT
- Any payment is non-refundable.
- The accepted currency is Pound Sterling (GBP).
- The client is required to pay 100% upfront or 50% upfront deposit and 50% after notification of completion.
- The client is required to pay via PayPal invoice. Invoices will be issued by the artist and the payment must be received within 3 working days of the invoice. Failure to pay within this period is seen as a breach of contract by the client, and will result in non-refundable termination of the commission.
III. PROCESS
- The artist will start working on the commission after receiving the payment.
- Progress updates are available upon request. A sketch is sent by default to be approved by the client.
- The artist will communicate with the client throughout the process of creating the commission. It is the client's responsibility to respond in a timely manner.
- The artist will not continue to work on commission without written approval from the client about the sketch.
- If the client has not approved the sketch within 30 days or has failed to keep in contact with the artist, the commission will be terminated, and payment will not be refunded.
- The client can request three minor changes (e.g. expression) and one major change (e.g. change of pose) at the stage of ‘Revision rounds’ for free. Any additional changes will require an extra fee.
- Any changes requested after approval of the sketch will require an extra fee unless those are mistakes made by the artist.
- The finished piece will be completed and digitally sent to the commissioner via e-mail unless agreed otherwise.
IV. TURNAROUND TIME
- Turnaround time can reach up to 3 months, but the artist will specify the exact (and probably shorter) turnaround time while discussing the commission.
- An expedited deadline or rush order has an additional charge quoted by the artist.
- If personal circumstances such as illness, loss of required technology, and other debilitating situations occur, the artist will inform all clients ASAP of said circumstance and discuss a new possible turnaround time.
V. USAGE RIGHTS
- The commission cannot be used to enter any competitions online or offline.
- All commissions completed fall under personal usage rights. The commission cannot be used for financial gain or marketing unless discussed otherwise. If the commission is for commercial use, new terms of the agreement must be signed and an extra commercial fee must be paid.
- I, the artist, hold every right to the produced drawing that falls under personal usage rights. The customer can: use the copyrighted artwork for personal use, print the art for personal use, and claim the right of their characters but not to the drawing itself.
- If the client decides to use the art to promote themselves or post the art to any social media platform, proper credit must be given to the artist. The Term 'proper credit' indicates linking any artist’s socials, tagging them or writing 'Art by @daedreams.co' in the post’s description.
- The client is forbidden from removing the artist’s signature and editing the finished piece unless agreed otherwise.
- I, the artist, may use the commissioned piece to promote myself on social media. The client will be credited as they request. The client is allowed to request for the commission to be completely private with an extra fee.
- If the client wishes to stay anonymous and not be credited when the artist posts commissioned piece, they have every right to do so.
By commissioning me you agree to the Terms of Service. By failing to abide by any of these you will be disallowed from ever commissioning me again, I have the right to report you to the proper authorities and publicly blacklist you for breaking my terms of service.
